Welcome to kingsislestore.com (the “Site”). The site is owned and operated by KingsIsle Entertainment ("KingsIsle"). The terms “we”, “us” and “our” used in the Terms of Servoce also refer to KingsIsle.
Please read these Terms of Service carefully as they apply to your use of the Site as well as when you purchase products through the Site. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, please do not use the Site.
SECTION 1 - NO USE BY MINORS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. . If you are under the age of majority in the jurisdiction in which you reside, your parent or guardian should use the Site on your behalf and you should not use the Site on your own or provide any personal information to KingsIsle.
SECTION 2 - CONCLUSION OF CONTRACT
The conclusion of the contract for the purchase of goods shall take effect by completing the order process and clicking the order button ("Buy Now" or similar) (offer of the customer) and the subsequent acceptance of the order via email or via shipment of the goods.
You may only purchase products through the Site for personal, non-commercial use outside of your trade, business, craft or profession.
SECTION 3 - SHIPPING COSTS
Shipping costs may vary depending on the delivery location and shipping method and will be displayed before completion of the order.
SECTION 4 - PRODUCTS
We strive to be as accurate as possible. However, we do not warrant that product descriptions, sizes, colors, styles or other content of this Site is accurate, complete, reliable, current, or error-free. We have made significant efforts to accurately display the colors and images of our products that appear at our Site. However, we cannot guarantee that your computer monitor's display of any color will be accurate. If a product you purchased is not as described, your sole remedy is to return it in unused condition.
We reserve the right, but are not obligated, to limit the sales of our products to geographic region or jurisdiction. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing on the Site are subject to change at anytime without notice before a purchase is made. We reserve the right to discontinue offering certain products at any time without prior notice or any liability.
SECTION 5 - ORDERING, ACCURATE BILLING AND ACCOUNT INFORMATION
We reserve the right to decline or reject all or part of an order you place with us for good reasons such as (a) if we detect suspicious or fraudulent activity in violation of these Terms of Service; (b) if your product ordered becomes unexpectedly and unavoidably unavailable due to circumstances beyond our reasonable control; (c) if we do not currently deliver to the country you want to ship the product to; or (d) there is an obvious error in the stated price at the point of sale. In the event that we make a change to or cancel an order, we notify you by contacting the e mail and/or billing address provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our Site. You agree to promptly update your account and other information, including your email address, so that we can complete your transactions purchases and contact you as needed.
SECTION 6 - RETURNS, REFUNDS
Under applicable law, consumers in the EU, EEA and the UK have a right to withdraw from or cancel certain purchases for a refund.
If you have your habitual residence within a Member State of the EU, of the EEA or in the UK and are entering into a contract with KingsIsle as a consumer (i.e. for purposes which are outside your trade, business, craft or profession), you have the right to withdraw from the contract as described below.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us, KingsIsle Entertainment Inc., 3800 Quick Hill Road, Austin, TX 78728, USA, phone: +1 512 623 5900, email: shopify@kingsisle.com, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to our print-on-demand drop shipper Printful (the return address depends on where your package was fulfilled, please check the address on Printful’s website), without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

In addition to other prohibitions as set forth in these Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Site. We reserve the right to terminate your use of the Site for violating any of the prohibited uses.
SECTION 10 - DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY; INDEMNIFICATION FOR US/CANADA CUSTOMERS
This section shall specifically only apply to customers from the US or Canada.
We do not guarantee, represent or warrant that your use of our Site will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Site will be accurate or reliable.
You agree that from time to time we may remove the Service Site for indefinite periods of time or cancel the Site at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Site is at your sole risk. The Site and all products made available to you through the Site are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall KingsIsle, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Site or any products made available to you through the Site, or for any other claim related in any way to your use of the Service Site or any product made available to you through the Site, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Site or any content (or product) posted, transmitted, or otherwise made available via the Site, even if advised of their possibility.
SECTION 11 - GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflicts of law principles. If you are a consumer, the mandatory consumer protection provisions applicable in your country of habitual residence shall also apply, provided that these provisions grant you a more comprehensive protection.
SECTION 12 - ADDITIONAL TERMS
KingsIsle may change these Terms of Service at any time by posting revised terms on the Site, including to reflect changes to our products or changes required by law. Any such new terms will be effective as of the date of posting and shall not be applicable to orders placed prior to the date the new terms are posted. This means that orders shall retain the terms in effect at the time they were placed.
Should individual provisions of these Terms of Service be or become invalid, this shall not affect the validity of the remaining provisions.
The Commission of the European Union provides an internet platform for online dispute resolution (ODR platform). The ODR platform serves as a possibility for the out-of-court settlement of disputes regarding contractual obligations arising from online purchase contracts or contracts between consumers and entrepreneurs with residence/registered office in the European Union. KingsIsle is not willing to participate in such out-of-court settlement of disputes arising from contracts with the costumer.
